Terms and conditions

General

These Terms & Conditions apply to all photography, videography, drone, floorplan, editing, and related media services provided by Jon Matthieu Real Estate Media.

By engaging Jon Matthieu Real Estate Media, the Client acknowledges and accepts these Terms & Conditions.

Jonathan Lim trading as Jon Matthieu Real Estate Media (ABN: 55746124757) may engage employees, subcontractors, assistants, editors, drone operators, or authorised representatives in the provision of services.

Unless otherwise agreed in writing, Jon Matthieu Real Estate Media operates as an independent contractor and retains discretion regarding scheduling, staffing, equipment, workflow, subcontracting, editing processes, and service delivery methods.

Bookings

Bookings are considered confirmed once accepted by Jon Matthieu Real Estate Media and any required deposit, prepayment, or confirmation has been received.

Bookings may be declined, rescheduled, or cancelled where reasonably necessary.

Property Preparation & Access

Properties must be clean, accessible, safe, and presentation-ready at the scheduled booking time.

Clients are responsible for ensuring:

  • legal property access,
  • permission from owners or occupants,
  • and a safe working environment.

Jon Matthieu Real Estate Media is not responsible for cleaning, staging, decluttering, moving furniture, or preparing the Property for photography or filming.

If a Property is not ready, inaccessible, unsafe, or unable to proceed at the scheduled time, services may be shortened, rescheduled, cancelled, or subject to additional fees.

If access delays, presentation delays, tenant delays, trades, cleaning, staging, or other onsite issues materially delay the scheduled booking, additional waiting fees, call-out fees, rescheduling fees, or reduced coverage may apply.

Standard additional fees may include:

  • waiting fees from $25 per 15 minutes (part thereof),
  • call-out fees from $75,
  • or partial/full booking fees for failed attendance or late cancellations.

Additional costs may vary depending on travel, scheduling impact, project scope, and lost booking time.

Failure of the Client, occupant, tenant, vendor, or representative to provide timely access may be treated as a late cancellation.

Weather & Drone Services

Photography, videography, and drone services remain subject to weather, lighting, safety conditions, CASA regulations, and airspace restrictions.

Drone imagery cannot be guaranteed at every Property.

Services may be rescheduled or modified where conditions are considered unsafe or unsuitable.

Turnaround Times

Standard turnaround times are approximately:

  • 2 working days for photography,
  • 5 working days for video deliverables.

Turnaround estimates are indicative only and may vary based on project scope, workload, revisions, weather, technical requirements, public holidays, and operational scheduling.

Urgent delivery requests may incur additional fees.

Editing & Revisions

Delivered Media includes Jon Matthieu Real Estate Media’s standard editing style and creative judgment.

Minor revision requests may be accommodated at discretion.

Additional editing, advanced retouching, virtual alterations, object removals, twilight conversions, or extensive revisions will be quoted or billed separately where applicable and may incur additional charges and extended turnaround times.

Requests considered misleading, deceptive, unethical, or inconsistent with advertising standards may be declined.

Creative Discretion

Jon Matthieu Real Estate Media retains creative discretion regarding composition, framing, editing style, colour grading, shot selection, and presentation of deliverables.

Final Media reflects professional and artistic judgment.

Licensing & Usage

Unless otherwise agreed in writing:

  • copyright remains with Jon Matthieu Real Estate Media,
  • and the Client receives a non-exclusive, non-transferable license for marketing the specific Property listing.

Media may not be:

  • transferred to another agency,
  • reused by future listing agents,
  • sold to third parties,
  • or reused for unrelated campaigns without written permission.

Where the Client is acting on behalf of a third party, agency, property owner, or real estate representative, the Client remains responsible for ensuring compliance with these Terms & Conditions.

Unless otherwise agreed in writing, RAW files, project files, working files, and unedited footage remain the exclusive property of Jon Matthieu Real Estate Media and are not included in standard deliverables.

Jon Matthieu Real Estate Media may use completed Media for portfolio, website, social media, advertising, awards, and promotional purposes unless otherwise agreed in writing.

Payments

New clients may be required to prepay invoices prior to the commencement of services or delivery of Media.

Standard payment terms for approved existing clients are Net 7 days unless otherwise agreed in writing.

Approved clients may be offered extended payment terms at the Photographer’s discretion.

The Client remains responsible for payment regardless of whether the Client has received payment from any third party, agency, property owner, or end customer.

Until full payment has been received:

  • all Media remains the property of Jon Matthieu Real Estate Media,
  • and any license granted to the Client for use of the Media is conditional and may be suspended for overdue invoices.

Invoices not paid by the due date may be subject to:

  • a late payment administrative fee of $25; and/or
  • interest accruing from the original invoice due date and calculated weekly at the Reserve Bank of Australia (RBA) Cash Rate plus 5% per annum on outstanding balances.

Late fees are intended to reasonably compensate for administrative time, recovery costs, account management, and delayed payment, and are not intended to operate as a penalty.

The Photographer may, at their sole discretion, allow a grace period of up to 7 calendar days before commencing recovery action or enforcing late payment remedies. Any grace period does not waive or alter the accrual of late fees from the original invoice due date.

Partial payments reduce the outstanding balance but do not waive late fees or recovery rights on overdue amounts. Interest will apply only to the outstanding unpaid balance remaining from time to time.

The Photographer reserves the right to engage debt recovery processes or request removal of unpaid Media from advertising, online listings, social media, printed materials, or marketing campaigns until outstanding invoices are settled.

The Client may also be liable for reasonable debt recovery, collection, legal, administrative, and associated enforcement costs incurred in recovering overdue amounts.

Marketing Accuracy & Floorplans

Clients are responsible for verifying all marketing information, descriptions, measurements, floorplans, and advertising materials prior to publication.

Floorplans and measurements are indicative only unless otherwise expressly certified.

File Storage

Standard real estate marketing projects are generally archived for approximately 30 days following delivery.

Commercial, architectural, editorial, builder, or design-related projects may be retained for longer archival periods at discretion.

Clients remain responsible for downloading and backing up all delivered Media.

Liability

To the maximum extent permitted by law, liability is limited to re-supplying affected services or refunding amounts paid for those services.

Jon Matthieu Real Estate Media is not liable for indirect or consequential loss, marketing outcomes, missed advertising deadlines, third-party platform failures, compression, upload issues, or quality degradation caused by external systems or platforms.

Additional Costs

Additional travel, parking, tolls, accommodation, permits, or location access costs may apply for certain projects.

Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia.

Operating Hours & Premium Scheduling

Standard operating hours are generally Monday to Friday, 9:00am to sunset.

Appointments requested outside standard operating hours, during premium scheduling periods, or within limited availability periods may be subject to increased rates, minimum booking requirements, adjusted turnaround times, call-out charges, or additional service fees.

Premium scheduling periods may include, but are not limited to:

  • Twilight Hour appointments scheduled within the 120-minute period prior to local sunset
  • Friday twilight appointments
  • Saturday appointments
  • Sunday appointments
  • Public holidays
  • After-hours appointments
  • Urgent or short-notice bookings

Indicative premium scheduling adjustments may generally range:

  • from approximately 30% above standard rates for selected twilight periods and Saturday morning appointments
  • from approximately 50% to 75% above standard rates for Friday twilight periods, Saturday afternoon appointments, and Sunday appointments
  • from approximately 150% above standard rates for public holiday, emergency, or short-notice premium scheduling requests

Additional charges or revised minimum booking requirements may apply depending on travel, scheduling impact, operational availability, staffing requirements, project scope, or lost booking opportunities.

Standard daytime service rates do not guarantee availability during premium scheduling periods.

Sunset times are determined based on the scheduled Property location and generally accepted local daylight or weather reporting sources.

Jon Matthieu Real Estate Media reserves the right to decline, reschedule, or limit bookings outside standard operating hours at discretion.
